Terms and Conditions (incorporating Refund and Cancellation Policy and Privacy & Cookie Policy)
1. The Cambridge Clinical website (the Site) is owned and operated by CANTAB MED LTD, trading as Cambridge Clinical, a company registered in England and Wales (company number 14333165) with a registered office at Cart House 2 Copley Hill Business Park, Cambridge Road, Babraham, Cambridge, United Kingdom, CB22 3GN.
2. Throughout this document, the terms “us”, “our” and “Cambridge Clinical” refer to CANTAB MED LTD, trading as Cambridge Clinical, and all directors, employees, contractors or other representatives. The phrases “The website”, “our website” or “Site” refer to the domain www.cambridgeclinical.co.uk and all pages within it.
3. By using the Site you agree to be bound by these terms of use (the Terms) together with the privacy and cookie policy accessible in the Site (the Privacy & Cookie Policy). These Terms and the Privacy & Cookie Policy affect your legal rights and obligations. If you do not agree to be bound by these Terms and/or the Privacy & Cookie Policy, do not use the Site.
4. These terms and conditions also apply to all other services offered by CANTAB MED LTD, trading as Cambridge Clinical, including, but not restricted to in-person and online courses and all other tuition services.
5. For the purposes of these Terms, “you” means any user of the Site, or any purchaser of any of the services offered by us.
6. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
7. We may assign or otherwise transfer our rights and obligations in terms of these Terms to third parties at our absolute discretion.
8. These Terms shall be governed by and construed in accordance with English law and in using our services you agree to submit to the exclusive jurisdiction of the English Courts.
9. Registering on the Site: To register and open and Account on our Site, you must be legally capable of entering into a contract. You may not register more than one Account on our Site.
10. When registering an Account on our Site, you will create a username and password. It is your responsibility to keep these details confidential and any activity on our Site under your username and password is your responsibility.
11. All purchase transactions are conducted via third-party merchants, over whom we have no control, and we do not have access to debit or credit card details.
12. We do not share customer details with any third parties. However, we reserve the right to retain for our own use details that you have provided us when registering an Account.
13. We will use all reasonable endeavours to make our Site available to you at all times. Scheduled maintenance, upgrades or repairs, emergency repairs, a failure of telecommunications hardware of software, however, may lead to an unavoidable disruption of service. While we shall endeavour to make such interruptions as short and non-disruptive as possible, we shall have no liability to you for such interruptions.
14. You are not permitted to contract privately with any Tutors introduced to you by us. If you do so, you agree to be liable to us for all fees we have paid to the Tutor, without deduction, and you agree that you shall remain liable to this condition even after the termination of this agreement.
15. You agree not to bypass, disable or otherwise attempt to interfere with any security or subscription-access-related features of the Site, including the accounts of clients and tutors, not to use the Site to publish or distribute, host, store, use or transmit any malicious software including, but not limited to, virus, spyware, Trojan Horse, worm, rootkit or keystroke logger, or to undertake any sort of data collection activity, including, but not limited to, data extraction, harvesting or mining, or scraping.
16. You agree not to undertake any type of attack on the Site, including, but not limited to, denial of service or distributed denial of service attacks
17. We reserve the right to suspend or delete your Account if you have breached any provision of these Terms & Conditions, whether deliberate or accidental, or if we you make any statement, whether verbal or written, direct or implied, that could injure our commercial or personal reputation. If we suspend or delete your Account, you may not use the Site, and you may not register a new Account under your own or another name.
18. The entire content of our Site, along with any materials that are provided in any other context, including, but not limited to, online and in-person courses, and 1-2-1 tutoring, are and will remain the Copyright property of us, and you agree not to copy/reproduce, modify, reverse engineer, publish, post, deep link, distribute, sell, licence, rent or otherwise cause to be sold, distributed or derivatised any such materials, whether for profit or not-for-profit.
19. Any logos/slogans used on our Site or in and on any of our materials provided in any form remain our intellectual property and may not be reproduced, modified or used in any way by you.
20. No representations, warranties or terms of any description are made in respect of this Site and its contents, and of any materials provided by us in any other context, other than those required by law.
21. All Site content, and all content of any other services provided by us, including, although not limited to in-person and online courses and tuition, should be considered only as guidance, and by using our Site and any materials provided by us, you indemnify CANTAB MED LTD, trading as Cambridge Clinical, its directors, employees, contractors or other representatives for any loss, howsoever arising, suffered or claimed to be suffered as a result of your use of our Site or of any other services provided by us. CANTAB MED LTD, trading as Cambridge Clinical makes no guarantees of UCAT success, however interpreted, and will not be held responsible or liable for any unsuccessful examination or interview outcomes, however interpreted.
Confirmation of Booking, Cancellation and Refund Policy
1. All bookings for all paid services, including Question Bank and Mock Examinations, live courses, both online and in-person, subscription video courses and any other paid service offered by Cambridge Clinical are considered confirmed only on receipt of full payment. Issue of a payment receipt, via our electronic payment processor, will provide confirmation of your booking.
2. You may cancel your Account at any time by notifying us in writing.
3. No refunds on subscriptions to the Question Bank and Mock Examinations provided via our Site will be offered to you, as access to both is available immediately on payment.
4. We will provide, on request, full refunds on all in-person or online ‘live’ courses and tuition, providing that a minimum of 14 days’ notice is given.
5. For rebooking requests concerning in-person or online ‘live’ courses, if your request is made more than 14 days before the course date you have already booked, we will move you to another date free of charge, as long as there is space available on the alternative date you have chosen. If your request to change date is made between 7 and 14 days before the course date you have already booked, we will move you to another date, as long as there is space available on the alternative date you have chosen, but we reserve the right to charge a £25 administration fee for doing so. We are unable to offer alternative dates where less than 7 days notice is given, and in such instances no refund will be made.
6. For cancellation or rebooking requests concerning tuition, for no fee to be payable, you must contact your Tutor directly, giving at least 24hrs notice. ‘No shows’ (defined as the failure of the student to attend the lesson within 15 minutes of the booked start time), and sessions cancelled with less than 24hrs notice, will be charged at the full rate.
7. In the event of a tutor having to cancel a lesson, the lesson will be rearranged by mutual agreement between the student and tutor and no additional fee will be payable by the student.
8. For online courses or lessons, it is your responsibility to ensure that you have a reliable internet connection and compatible hardware that has a functioning webcam and microphone. No refunds will be offered for technical failures of the equipment you use to access our courses or resources.
9. CANTAB MED LTD trading as Cambridge Clinical, its directors, employees, contractors or other representatives, reserves the right, at its absolute discretion, to cancel any event or service provision for any reason and at any time. In respect of such an occurrence, you will be entitled to a full refund of all monies paid to us, but we will not be held liable for any additional costs incurred by you, including, but not limited to, travel, accommodation or food.
Terms and Conditions Law and Jurisdiction
All terms and conditions adopted by CANTAB MED LTD trading as Cambridge Clinical are construed in and governed by English Law. Any disputes arising will be subject to the exclusive jurisdiction of the English courts and your use of the Site or any of the products offered by CANTAB MED LTD trading as Cambridge Clinical constitutes your acceptance of this term.
